It may be one of spring's most ubiquitous trends, but neon is illegal in the US - at least in nail polish form. But don't shun or rush to get all your favorite electric polishes just yet: it's only illegal to produce them in America, and the legality has nothing to do with harmful chemicals being present in the polish. According to CNDs scientific chief advisor Doug Schoon, it seems neon colors have simply never been registered with the FDA. Geez, who dropped the ball on that one?
He further explains that nail polish colorants must be approved by the FDA before manufacturing, and because no one has ever bothered to register neon colors, any of fluorescent greens or hyper-bright oranges are imported. What determines a neon color as opposed to other hues is the chemical composition - apparently it's expensive and time consuming to register colors. Hmmmm....seems like either a big oversight or a weak excuse for general laziness.
Some smaller manufacturers have gone ahead a produced the neon colors while other larger companies who "play by the rules" are less likely to get the book thrown at them when the FDA eventually catches up with the scheme. Most companies, though, produce bright and colorful palettes that get the same neon look without 'compositionally' actually being neon.
I still don't know how I feel about this...any of you make heads or tails of the nail industry's laziness?
