In what has to be the most badass last will and testament stipulation this side of The Shins' "Simple Song" video, it was revealed yesterday that Adam "MCA" Yauch's will prohibits the use of his music, art or likeness in any form for commercial advertising purposes. Part of the reason we're hearing about it has to do with remaining Beastie Boys' lawsuit against Monster Energy Drinks, filed two days ago.
According to the suit (as reported by SPIN.com), the beverage company used the band's music in a three-minute video for their Ruckus in the Rockies promotion and utilized the trio's respective likenesses in a social media campaign video that also linked to a 23-minute mega mix by DJ Z-Trip that features… drum roll please… 26 Beastie Boys songs in total. Yeah, whoops.
Added insult to injury? The Monster stuff went live on May 9, just five days after MCA's death from cancer-related complications. Yeah, way to go, guys. Feel free to read the entire lawsuit text right here—Adam "Ad-Rock" Horowitz and Michael "Mike D" Diamond are seeking an injunction and damages of $150,000 for each copyright infringement. Let that be a message to you, energy drink companies: MCA will still find a way to stir fry you in his wok, even from beyond the grave.
